Privacy Policy
This Privacy Policy explains how One Black Pixel LLC collects, uses, shares, and protects information when you visit oneblackpixel.com, and when you use applications and services powered by our VNDY software platform (collectively, the “Services”).
1) Scope and roles
VNDY is a software platform that powers mobile commerce applications for independent businesses (“Merchants”). When you purchase goods through a Merchant’s app, the Merchant (not One Black Pixel) is the seller and Merchant of Record and is responsible for fulfilling orders, handling returns/refunds, providing customer service, and meeting tax obligations.
One Black Pixel provides the technology infrastructure that enables the Merchant’s app to function. This policy describes One Black Pixel’s data practices for the Services we operate. A Merchant may also have its own privacy policy covering how it uses customer information for its business operations.
2) Information we collect
We may collect the following categories of information, depending on how you interact with the Services:
- Contact and account information: such as name, email address, phone number, and login identifiers.
- Order and transaction information: such as items purchased, order totals, shipping details, and timestamps. Payment card details are processed by our payment processors (e.g., Stripe) and are not stored by One Black Pixel.
- Content you provide: such as photos, videos, product reviews, support requests, messages, or other content submitted through a Merchant’s app or through our website.
- Device and usage information: such as IP address, device identifiers, operating system, app version, language, approximate location derived from IP, crash logs, performance data, and interactions with the Services.
- Location information: if a Merchant’s app requests permission, we may collect location data to support features you use (e.g., delivery estimates or store-related functionality). You can control location permissions through your device settings.
- Cookies and similar technologies (website): we may use cookies and similar tools on our website to remember preferences, provide core functionality, and understand usage patterns. Some third-party tools may also set cookies.
3) How we use information
We use information to:
- Provide, operate, maintain, and improve the Services (including debugging, analytics, and performance monitoring).
- Enable core app functionality for Merchants and their customers (e.g., account access, order processing, and notifications).
- Process transactions and facilitate payments through third-party payment processors.
- Provide customer support and respond to requests.
- Detect, prevent, and investigate fraud, abuse, security incidents, and illegal activity.
- Comply with legal obligations and enforce our terms and policies.
4) How information is shared
We may share information in the following circumstances:
- With the Merchant: if you use a Merchant’s app, information such as orders, contact details, and support messages may be accessible to that Merchant so they can fulfill orders and provide customer support.
- With service providers: vendors that help us run the Services (e.g., hosting, analytics, crash reporting, email delivery). They are authorized to process information only as needed to provide services to us.
- With payment processors: to process transactions (e.g., Stripe). Payment processors handle payment details under their own privacy policies.
- For legal and safety reasons: to comply with law, respond to lawful requests, protect rights and safety, or investigate fraud.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate protections.
We do not sell your personal information in the traditional sense. If laws in your jurisdiction define “sale” or “sharing” broadly (including certain advertising-related disclosures), you may contact us using the details below for information about available choices.
5) Cookies and analytics (website)
Cookies are small files stored on your device that help websites function and remember preferences. Our website may use cookies for essential functionality and to understand usage trends. Third-party analytics tools may also use cookies or similar technologies.
You can typically control cookies through your browser settings. Note that disabling certain cookies may impact site functionality.
6) Data retention
We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and for legitimate business purposes. Retention periods can vary depending on the type of information, how it is used, and legal requirements.
7) Security
We use commercially reasonable administrative, technical, and organizational safeguards designed to protect information. However, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security.
8) Children’s privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, please contact us and we will take appropriate action.
9) Your choices and rights
Depending on your location, you may have rights to access, correct, delete, or obtain a copy of certain personal information, or to object to or restrict certain processing.
- Account information: you can update certain information through the applicable app or by contacting the Merchant.
- Deletion requests: you may request deletion of personal information by contacting us. We may need to retain certain data for legal, tax, fraud-prevention, or operational reasons.
- Merchant relationship: if your request relates to an order or a Merchant’s customer relationship, we may route your request to the Merchant or instruct you to contact them directly.
10) International users
One Black Pixel is based in the United States. If you access the Services from outside the U.S., your information may be transferred to, stored, and processed in the U.S. or other locations where we or our service providers operate.
11) Changes to this Privacy Policy
